Pennsylvania woman dead in car accident

A woman is dead after she attempted to get help following an initial accident, according to local news sources. Pennsylvania State Police responded to the car accident that occurred at approximately 8:45 p.m. on Christmas Eve on Route 78. So far, police have not filed charges against anyone involved in the Lehigh County crash, which injured several other people. 

According to the accident report, the 29-year-old woman had been involved in a seemingly minor accident after her car struck the center median. When she exited the vehicle to seek help, she was struck by an SUV, which then struck two other individuals who also pulled over to help. The woman was rushed to a local hospital, where she was later pronounced dead. 

The other two individuals who were struck were also taken to a local hospital, though they were treated and released. It is not clear from the news report if the two were still in their vehicle, a Jeep Cherokee, when they were hit. The driver who struck the three pedestrians was not been charged with a crime in the immediate aftermath of the crash. 

At this time, too little information is available to determine whether claims for personal injuries (by the surviving victims) or for wrongful death (by the deceased victim’s surviving family) may be appropriate. When more than one party causes or contributes to a car accident, Pennsylvania is known as a modified comparative negligence state. That means that so long as a party to an accident is no more  than 50 percent responsible for the accident, recovery of damages against another responsible party is possible. In those instances, however, the amount of any monetary judgment awarded is reduced by the degree of fault of the party seeking financial relief.
